Introduction
Welcome to Mock. These Terms of Service ("Terms") are an agreement between you and Mock and apply whenever you visit, sign up for or use the Mock website and services (the "platform"). By using the platform you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the platform.
1. The service
Mock is an online assessment platform that helps educators and institutions set, deliver, invigilate and mark exams securely. It includes, among other things, timed exams, exam-integrity monitoring, live invigilation tools for teachers, automatic and AI-assisted marking, and results reporting. We keep improving the platform, so features may be added, changed or retired over time.
2. Who may use Mock
- Educators and institutions must be at least 18 years old, or the age of majority where they live, and able to agree to these Terms. If you sign up for a school or organisation, you confirm that you are allowed to accept these Terms on its behalf.
- Students use Mock through their school or teacher, who decides which students may sit which exams. Students under 18 use the platform under the supervision of their school, teacher or parent.
3. Accounts and security
- You must give accurate information when you sign up and keep it up to date.
- You are responsible for keeping your password and your exam codes confidential, and for everything done through your account.
- Tell us straight away at support@mockassessment.com if you think someone has used your account without permission.
- Free accounts are for genuine individual use. Creating several accounts to collect free credits or to get around limits is not allowed.
4. Teachers' and schools' responsibilities
- You are responsible for the exams you create and the students you add, and for having a lawful basis to add them, including a parent's or guardian's consent where the law requires it.
- You are responsible for the questions your students see and for the marks you give. AI suggestions are there to help you; they never replace your professional judgement, and you should review them before relying on them.
- You decide how exam results are used, and you deal with your students' questions or appeals about their marks.
5. Students' responsibilities
When you sit an exam on Mock, you agree to follow the rules your teacher sets and the instructions on the exam screen, to sit the exam yourself, and not to share exam questions or codes. Exams are monitored to protect their fairness, and your teacher can see the outcome.
6. Fair use and exam integrity
Mock is built on integrity. You agree not to:
- bypass, disable or tamper with the platform's exam-integrity features, timers or security;
- access an exam, an account or data that is not yours, or impersonate someone else;
- copy, reverse-engineer, scrape or try to extract the platform's software or source code;
- overload, disrupt or probe the platform, or use automated tools to access it;
- upload anything unlawful, harmful or infringing, or any malicious software;
- use the platform for anything illegal.
If you break these rules or put other users or the platform at risk, we may suspend or close the account involved, with or without notice, and report serious matters to the relevant authorities.
7. Plans, credits and payments
- Some features need a paid plan or credits. Prices and what each plan includes are shown in your account before you pay.
- Payments are processed securely by our payment partners, such as Paystack. Their own terms and privacy policy (opens in a new tab) also apply to your payment.
- Credits have no cash value and can't be transferred, sold or exchanged. Free and allowance credits may expire or reset as described for your plan; credits you buy are kept on your account while it stays open.
- Fees are non-refundable, except where the law requires a refund, or where a payment was taken but the plan or credits were not delivered and we can't fix that.
- We may change our prices. A change applies from your next purchase or renewal, and we will tell you before it affects a plan you already pay for.
- School and campus contracts agreed with us in writing follow their own terms where they differ from these.
8. Your content
Exams, questions and materials you create or upload remain yours. You give Mock permission to store, display and process them only to provide the platform to you and your students, as explained in the Copyright section of our Privacy Policy & Copyright Notice. You confirm you have the right to use what you upload.
9. Our intellectual property
The Mock name, brand and acronym, the platform's software, design, features and original content belong to Mock and are protected by the Copyright Act of Kenya, trademark law and international treaties. These Terms give you the right to use the platform; they don't give you any ownership of it.
10. Availability and changes
We work hard to keep Mock available and accurate, but we can't promise it will always be uninterrupted or error-free. We may carry out maintenance, and we will try to schedule planned work outside common exam hours. Internet connections, devices and other services outside our control can affect an exam.
11. Limitation of liability
The platform is provided "as is" and "as available". To the fullest extent the law allows:
- we are not liable for indirect or consequential loss, or for loss of data, results, time or opportunity caused by internet or power outages, devices, third-party services, or events outside our reasonable control;
- our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose.
Nothing in these Terms limits any right you have that the law does not allow us to limit, including under the Consumer Protection Act of Kenya.
12. Closing your account
You can stop using Mock at any time, and teachers can delete their account from their dashboard. What happens to your data when you do is explained in our Privacy Policy. We may close accounts that break these Terms, or that stay unused for a long time after we have tried to contact you.
13. Changes to these Terms
We may update these Terms as the platform grows. We will post the new version here with a new date and tell account holders about important changes before they take effect. If you keep using Mock after that, you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of Kenya. If a dispute arises, please contact us first and we will try to resolve it fairly and quickly. If we can't, the courts of Kenya will decide it. Wherever you use Mock, you are also responsible for following the laws that apply where you are.
